You must be at least 18 years old to create a PLUS account or use the PLUS Services.

By using PLUS, you represent that:

1. You are at least 18 years old.
2. You have the legal capacity to agree to these Terms.
3. The information you provide is truthful and reasonably accurate.
4. You will use PLUS only for lawful purposes.
5. Your use of PLUS does not violate any applicable law or contractual obligation.

PLUS is primarily designed for adults in committed relationships.

You do not have to be legally married to use PLUS.

 

3. Your PLUS Account

 Certain PLUS features require you to create an account.

You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of your login credentials
• Keeping your email address, phone number, and other contact information current
• Protecting access to devices through which your PLUS account may be accessed
• Promptly notifying PLUS if you believe your account has been accessed without authorization

You may not:

• Impersonate another person
• Create an account using another person's information without permission
• Provide intentionally false or misleading account information
• Attempt to access another user's account without authorization
• Share login credentials in a manner that compromises account security

You are responsible for activity occurring through your account to the extent permitted by applicable law.

4. Connecting With a Partner

 PLUS is designed to allow two participating partners to connect their accounts.

Each partner should maintain their own PLUS account.

Connecting with a partner does not give either person ownership of or unrestricted access to the other person's account.

Each partner remains individually responsible for:

• Their own login information
• Their own responses
• Their own account settings
• Their own consent decisions
• Their own participation in optional PLUS programs

One partner may not provide legal consent on behalf of another partner unless legally authorized to do so.

5. Partner Feedback

 An important function of PLUS is providing relationship feedback to your connected partner.

This may include:

• Ratings
• Written comments
• Daily Check-In information
• Weekly Check-In information
• Relationship observations
• Items identified as something that needs to be discussed
• Relationship Health Scores
• Relationship trends
• Other information identified within PLUS as information intended to be shared with your partner

When PLUS identifies information as partner feedback or shared relationship information, you should understand that your connected partner may be able to view it.

Do not submit information through a partner-feedback field that you do not want communicated to your participating partner.

6. Respectful Use of PLUS

PLUS exists to encourage constructive relationship awareness and improvement.

You agree not to use PLUS to:

• Threaten another person
• Harass or intimidate another person
• Stalk another person
• Humiliate or intentionally degrade another person
• Engage in unlawful discrimination
• Submit knowingly false or malicious allegations
• Exploit another user
• Attempt to control another person's account
• Obtain unauthorized access to another person's information
• Upload malicious software or code
• Interfere with the operation of PLUS
• Use PLUS for fraudulent or unlawful activity
• Encourage conduct that violates applicable law

PLUS may take reasonable action in response to misuse, including restricting or terminating access to the PLUS Services.

7. Relationship Feedback Is Subjective

Ratings and written responses submitted through PLUS reflect each individual's perception and experience.

A rating provided by one partner should not be interpreted as an objective determination about:

• The other partner's character
• The overall quality of the relationship
• Whether one partner is “right” or “wrong”
• Whether a relationship is healthy or unhealthy
• Whether a couple should remain together
• Whether separation or divorce should occur
• Whether a person has a mental-health or clinical condition

Two people can experience the same relationship very differently.

PLUS is designed to make those differences more visible so couples can better understand one another and respond intentionally.

8. Relationship Health Scores

PLUS may calculate or display relationship-related scores, trends, ratings, participation measures, or other indicators.

These measurements are informational tools.

They may be based upon information submitted through PLUS as well as participation, consistency, alignment between partners, relationship feedback, and other methodologies used by the application.

A PLUS Relationship Health Score:

• Is not a clinical diagnosis
• Is not a psychological evaluation
• Is not a prediction that a relationship will succeed or fail
• Does not establish abuse or the absence of abuse
• Does not determine compatibility
• Does not determine whether a person should marry, remain married, separate, or divorce
• Should not be treated as professional medical, psychological, legal, or financial advice

A score cannot perfectly capture the complexity of a relationship.

Its purpose is to help bring important patterns to your attention.

PLUS may modify scoring methodologies or features as the application evolves.

9. PLUS Is Not Therapy

PLUS is a relationship education, feedback, awareness, and self-improvement tool.

Use of PLUS does not create a therapist-client relationship.

Although PLUS may incorporate concepts informed by professional experience, psychological research, relationship education, or the professional background of its founder, PLUS itself is not psychotherapy.

Using PLUS does not establish a therapist-client relationship with:

• Emil Harker, MS, LMFT
• Any other mental-health professional associated with PLUS
• Any PLUS employee or contractor

PLUS is not a replacement for professional assessment, psychotherapy, marriage therapy, medical care, legal advice, or other professional services when those services are appropriate.

10. No Professional Diagnosis

PLUS does not diagnose:

• Mental-health disorders
• Relationship disorders
• Medical conditions
• Personality disorders
• Addiction
• Domestic violence
• Abuse
• Sexual dysfunction
• Other medical or psychological conditions

Educational content provided through PLUS should not be interpreted as individualized professional diagnosis or treatment.

11. PLUS Is Not an Emergency Service

PLUS is not designed to provide emergency assistance.

PLUS does not continuously monitor:

• Check-In responses
• Partner comments
• Ratings
• Relationship Health Scores
• Areas identified as needing discussion
• Other user communications for emergencies or immediate threats

Do not use PLUS as a method for requesting emergency assistance.

If you believe that you or another person is in immediate danger, seek appropriate emergency assistance in your location.

12. Relationship Safety

Certain relationship circumstances may require help beyond what PLUS can provide.

If you are concerned about:

• Violence
• Threats
• Coercion
• Stalking
• Sexual assault
• Abuse
• Serious intimidation
• Immediate personal safety

consider obtaining appropriate professional or emergency assistance rather than relying on PLUS to resolve the situation.

Relationship communication tools that may be useful during ordinary relationship conflict may not be appropriate in abusive, coercive, or dangerous situations.

13. Relationship Resources and Automated Messages

PLUS may provide educational messages, suggestions, or resources based upon information supplied through the application.

For example, PLUS may provide additional resources when feedback indicates that a particular relationship area could benefit from greater attention.

These resources are intended to:

• Encourage reflection
• Provide education
• Suggest possible relationship skills
• Identify possible areas for improvement
• Help users respond constructively to feedback
• Encourage users to obtain additional support when appropriate

Automated recommendations are not individualized clinical assessments.

Receiving or not receiving a particular resource should not be interpreted as a professional determination about the health or safety of your relationship.

14. User Content

“User Content” includes information you submit to PLUS, including:

• Written Check-In responses
• Ratings
• Comments
• Feedback
• Relationship observations
• Support communications
• Other information you voluntarily submit

You retain ownership of your original User Content to the extent that ownership rights apply.

You grant PLUS a limited license to store, process, reproduce, transmit, display, and otherwise use User Content only as reasonably necessary to operate, provide, secure, maintain, improve, and administer the PLUS Services and as otherwise described in the PLUS Privacy Policy and your applicable consent choices.

This license does not transfer ownership of your User Content to PLUS.

15. Responsibility for User Content

You are responsible for the information you submit.

You agree that you will not knowingly submit User Content that:

• Violates applicable law
• Infringes another person's intellectual-property rights
• Contains malicious software
• Is submitted through unauthorized access to another person's account
• Is intended to misuse, damage, or disrupt PLUS

PLUS reserves the right to restrict content or account access when reasonably necessary to protect users, comply with law, enforce these Terms, or protect the integrity of the PLUS Services.

16. Privacy

Your privacy is important to PLUS.

Our collection, processing, use, retention, protection, and disclosure of personal information are further described in the:

These documents should be reviewed together with these Terms.

If these Terms and the Privacy Policy address the handling of personal information differently, the Privacy Policy will control regarding the handling of personal information.

17. PLUS Marriage Initiative

PLUS offers users the opportunity to voluntarily participate in the PLUS Marriage Initiative.

The Marriage Initiative is intended to help PLUS learn from eligible de-identified or aggregated relationship information in ways that may:

• Improve PLUS
• Improve relationship education
• Identify relationship trends
• Develop better relationship resources
• Increase understanding of relationship patterns
• Develop practical solutions to needs experienced by real couples
• Contribute to broader efforts intended to strengthen marriages and relationships

Participation in the Marriage Initiative is optional.

You are not required to participate in the Marriage Initiative in order to use the ordinary PLUS Services.

Participation is governed by the PLUS Privacy, Consent & Marriage Initiative Participation document and the user's individual consent choice.

18. Changing Marriage Initiative Participation

Users who participate in the Marriage Initiative may change their participation preference using the methods provided through PLUS or by contacting:

Withdrawal applies to future participation as described in the applicable Privacy and Consent documents.

Information that has previously been permanently de-identified and incorporated into aggregate statistics, analyses, or reports may no longer be reasonably capable of being connected back to an individual user and therefore may not be removable.

19. Intellectual Property

Except for User Content and third-party materials, PLUS and its associated materials are owned by or licensed to PLUS and/or Individual & Relational Therapy.

This may include:

• The PLUS name
• Logos
• Branding
• Application design
• Software
• Graphics
• Educational materials
• Videos
• Written content
• Relationship exercises
• Scoring methodologies
• Training materials
• Databases
• Resource libraries
• Other original content

These materials may be protected by copyright, trademark, trade-secret, and other intellectual-property laws.

20. Limited License to Use PLUS

Subject to these Terms, PLUS grants you a limited, personal, revocable, non-exclusive, nontransferable license to use the PLUS Services for your own personal purposes.

This license does not allow you to:

• Resell PLUS
• Reproduce substantial portions of PLUS content for commercial purposes
• Reverse engineer PLUS except where applicable law expressly permits it
• Copy or distribute proprietary PLUS materials without authorization
• Circumvent technological restrictions
• Scrape or systematically extract PLUS data
• Create competing datasets from PLUS information
• Use PLUS intellectual property without authorization

21. Subscriptions

Some PLUS features may require a paid subscription.

Before purchasing a subscription, you will be provided with applicable information regarding:

• Price
• Billing frequency
• Subscription duration
• Included features
• Renewal terms

Unless otherwise stated, subscriptions may automatically renew until cancelled.

Subscription pricing and features may change in accordance with applicable law and the requirements of the payment platform through which the subscription was purchased.

22. Apple App Store Purchases

If your subscription or purchase is processed through Apple's App Store, payment, renewal, cancellation, and applicable refund procedures may be administered by Apple and are subject to Apple's applicable terms and policies.

PLUS does not control Apple's billing systems.

Deleting your PLUS account does not necessarily cancel an Apple subscription.

Users are responsible for managing App Store subscriptions through the applicable Apple account.

23. Google Play Purchases

If your subscription or purchase is processed through Google Play, payment, renewal, cancellation, and applicable refund procedures may be administered by Google Play and are subject to Google's applicable terms and policies.

PLUS does not control Google's billing systems.

Deleting PLUS or deleting your PLUS account does not necessarily cancel an active Google Play subscription.

Users are responsible for managing subscriptions through the applicable Google account.

24. Direct PLUS Purchases

PLUS may offer certain products or services directly.

Direct purchases may include educational resources, digital products, coaching, or other services and may be processed through third-party payment providers.

Certain PLUS-related charges may appear on billing records under the legal business name:

Additional billing terms may apply to direct purchases.

Never send complete payment-card or bank-account information through ordinary PLUS support email.

25. Cancellation

You may cancel a subscription using the cancellation process associated with the platform through which you purchased it.

Cancellation generally prevents future renewal but does not necessarily terminate access immediately.

Depending upon the subscription and payment provider, paid features may remain available through the end of the already-paid billing period.

Deleting the PLUS application from your device does not itself cancel a subscription.

Deleting your PLUS account also does not necessarily cancel a subscription administered through Apple, Google, or another payment provider.

26. Refunds

Refunds are governed by the PLUS Refund Policy and, where applicable, by the policies of the platform through which the purchase was made.

PLUS may occasionally offer:

• Free trials
• Promotional pricing
• Discount codes
• Complimentary access
• Sponsored offers
• Other promotions

The specific conditions disclosed with an offer apply to that promotion.

PLUS may limit promotional offers based upon eligibility, geographic location, previous participation, or other reasonable criteria.

28. Points, Achievements, and Other In-App Rewards

PLUS may provide points, achievements, streaks, badges, leaderboard status, or similar features intended to encourage consistent participation.

Unless PLUS specifically states otherwise:

• Points have no monetary value
• Points are not currency
• Points cannot be redeemed for cash
• Points cannot be transferred between accounts
• PLUS may modify or discontinue a points or rewards system

If PLUS later offers specific rewards or benefits in exchange for points, additional terms may apply.

29. Third-Party Services

PLUS may rely upon third parties for services such as:

• Mobile application distribution
• Payment processing
• Cloud hosting
• Email
• SMS delivery
• Analytics
• Authentication
• Notifications
• Other technology infrastructure

Your use of certain third-party services may also be governed by those providers' terms and privacy practices.

PLUS is not responsible for third-party services to the extent permitted by applicable law.

30. Links to Third-Party Resources

PLUS may provide links to outside websites, products, articles, professionals, educational resources, or services.

Providing a link does not necessarily mean that PLUS:

• Owns the third-party service
• Controls it
• Guarantees it
• Endorses every statement made by it
• Guarantees results from using it

Users should evaluate outside resources according to their own circumstances.

31. Availability of PLUS

We want PLUS to be reliable, but uninterrupted availability cannot be guaranteed.

PLUS may occasionally be unavailable because of:

• Maintenance
• Updates
• Internet disruptions
• Hosting outages
• Device compatibility issues
• Third-party service failures
• Security issues
• Software errors
• Circumstances beyond our reasonable control

PLUS may modify, update, replace, add, suspend, or discontinue features as the service evolves.

32. Updates to the Application

PLUS may release updates to:

• Improve functionality
• Correct errors
• Improve security
• Introduce new features
• Modify existing features
• Maintain compatibility with operating systems and third-party services

Certain functionality may require installation of the latest available version of PLUS.

33. Account Deletion

Users may initiate or request deletion of their PLUS account through the methods provided within the application or through the PLUS Support Center.

Account deletion is different from subscription cancellation.

If you have an active subscription through Apple, Google, or another payment provider, you should separately confirm cancellation of that subscription.

Information associated with a deleted account will be handled according to:

• Security requirements
• Legitimate record-retention requirements

34. Effect on a Connected Partner

Because PLUS connects participating partners, termination, deletion, or disconnection of one partner's account may affect functionality available to the other partner.

PLUS does not guarantee preservation of all shared relationship features after one participating partner:

• Disconnects
• Deletes an account
• Terminates participation
• Becomes unavailable

35. Termination or Suspension by PLUS

PLUS may suspend or terminate access when reasonably necessary because of:

• Serious or repeated violations of these Terms
• Fraud
• Unauthorized access
• Illegal activity
• Threats to the safety or security of PLUS or its users
• Abuse of the service
• Failure to pay applicable charges
• Legal or regulatory requirements
• Discontinuation of the PLUS Services

When appropriate and reasonably possible, PLUS may provide notice or an opportunity to resolve the issue.

36. No Guaranteed Relationship Outcome

Relationships are affected by many factors beyond PLUS's control.

PLUS does not guarantee that using the application will:

• Improve your marriage or relationship
• Prevent separation or divorce
• Resolve relationship conflict
• Increase intimacy
• Change your partner's behavior
• Produce a particular Relationship Health Score
• Prevent infidelity
• Restore trust
• Eliminate disagreements
• Produce any particular emotional or relationship outcome

PLUS provides tools intended to support intentional relationship development.

How users understand and apply those tools remains their responsibility.

37. Disclaimer of Warranties

To the fullest extent permitted by applicable law, PLUS is provided on an “as is” and “as available” basis.

Except where prohibited by law, PLUS does not guarantee that:

• The service will always be available
• Every feature will operate without error
• Information will never be lost
• Every recommendation will be appropriate for every relationship
• Results will meet a user's expectations
• The service will produce a particular relationship outcome

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

38. Limitation of Liability

To the fullest extent permitted by applicable law, PLUS, Individual & Relational Therapy, and their owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to use of the PLUS Services.

This may include, where legally permitted:

• Loss of data
• Lost profits
• Lost business opportunities
• Emotional distress
• Relationship disputes
• Decisions made based upon relationship feedback
• Actions of another PLUS user
• Inability to access the PLUS Services

Where liability cannot legally be excluded, liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms is intended to limit liability that cannot legally be limited.

39. Decisions Between Partners

Users remain responsible for their own relationship and personal decisions.

PLUS is not responsible for decisions made by users concerning:

• Marriage
• Separation
• Divorce
• Parenting
• Sexual relationships
• Financial decisions
• Living arrangements
• Legal proceedings
• Counseling
• Medical treatment
• Other significant personal matters

Users should obtain appropriate professional advice when circumstances warrant it.

40. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses resulting from:

• Your unlawful use of PLUS
• Your material violation of these Terms
• Your unauthorized access to another person's account
• Your infringement of another person's rights
• Content you knowingly submit in violation of applicable law

This provision does not require users to indemnify PLUS for conduct for which indemnification cannot legally be required.

41. Governing Law

Unless applicable consumer law requires otherwise, these Terms will be governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles.

Mandatory consumer protections available to users in their jurisdiction are not waived where applicable law prohibits such waiver.

42. Resolving Disputes

Before initiating formal legal proceedings concerning PLUS, you and PLUS agree, when reasonable, to first attempt to resolve the matter informally.

43. Users Outside the United States

PLUS may be accessible from locations outside the United States.

Users are responsible for determining whether their use of PLUS complies with applicable local laws.

Certain provisions of these Terms may be limited or superseded by mandatory consumer laws in a user's jurisdiction.

Nothing in these Terms is intended to eliminate rights that applicable law does not permit a user to waive.

44. Apple-Specific Terms

If you access PLUS through an Apple device or obtain PLUS through the Apple App Store, you acknowledge that:

• These Terms are between you and PLUS, not Apple
• Apple is not responsible for providing PLUS
• PLUS, rather than Apple, is responsible for maintenance and support of the application except as otherwise required by law
• Apple is not responsible for claims relating to PLUS except as required by applicable law
• You must comply with applicable App Store usage rules
• Apple and its subsidiaries may have rights as third-party beneficiaries of applicable end-user license terms

Your use of the Apple-distributed version of PLUS is also subject to applicable Apple terms and policies.

45. Google Play-Specific Terms

If you access PLUS through Google Play, your use of Google Play and transactions processed by Google are also subject to applicable Google Play terms and policies.

If these Terms conflict with mandatory Google Play requirements governing transactions processed by Google, the applicable Google Play requirements will control with respect to those transactions.

46. Changes to PLUS

PLUS will continue to evolve.

We may add, remove, modify, or discontinue features when reasonably necessary to:

• Improve PLUS
• Respond to user feedback
• Address security concerns
• Meet legal requirements
• Improve relationship resources
• Change technology providers
• Develop the PLUS Services

Not every previous feature is guaranteed to remain available indefinitely.

47. Changes to These Terms

PLUS may update these Terms periodically.

When changes are material, PLUS may provide notice through:

• The PLUS application
• Email
• The PLUS website
• Another appropriate method

The updated Terms will include a revised effective date or “Last Updated” date.

When required by applicable law, PLUS will request additional consent before material new terms become effective.

Continued use of PLUS after updated Terms become effective constitutes acceptance where permitted by applicable law.

48. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

The invalid provision will be interpreted or limited as necessary to make it enforceable where legally permissible.

49. No Waiver

If PLUS does not immediately enforce a provision of these Terms, that does not mean PLUS permanently waives its right to enforce that provision later.

50. Entire Agreement

These Terms, together with applicable policies and agreements referenced within them, constitute the agreement between you and PLUS regarding use of the PLUS Services.
